Usage and User Agreement

This agreement contains the rules necessary for you to benefit from the services on our site. By becoming a member of our site; You accept, declare and undertake that you have read the user agreement, understood and approved its content and provisions.

1- Parties
This Arkipedia Usage and User Agreement (hereinafter referred to as the ‘User Agreement’), consisting of this agreement and the documents referred to in this agreement and which are an integral part of the agreement, is between arkipedia.net and the User who logs into the Site, and the User’s use of the Site. It is arranged for the purpose of logging in or becoming a member and at the time the contract is approved by the user in the electronic environment where the relevant site is located. By logging in to our site or becoming a member; You accept, declare and undertake that you have read the user agreement, understood and approved its content and provisions.

2- Definitions
Arkipedia.net is a publishing site that prepares various articles together with its users and presents them publicly, or privately when necessary. In this agreement, articles, comments, questions, answers, groups, forums prepared by users who are members of the site or anonymous visitors will be referred to as “content”. The information you provide voluntarily while becoming a member of the site or later in your profile will be referred to as “personal data”. The natural or legal person who becomes a member of the site and benefits from all services offered on the site under the conditions specified in this agreement will be referred to as “user”.

3- Subject and Scope of the Agreement
The subject of the User Agreement is the determination of the services offered on the site, the conditions for benefiting from these services and the rights and obligations of the parties. The scope of the User Agreement is this agreement and its annexes and all statements such as warnings, articles and explanations made by Arkipedia regarding the use, membership and services on the site. By accepting the provisions of the User Agreement, the User also accepts all statements made by Arkipedia regarding the use, membership and services on the site. The User accepts, declares and undertakes to act in accordance with all matters specified in the aforementioned statements.

4- Terms of Membership and Service Use
Membership is completed by completing the registration process by sending the necessary information to become a member of the site by the person who wants to become a user, from the relevant sections of the site. Without completing the membership process, you cannot have the right and authority to become a User as defined in this agreement. In order to become a member of the site, it is necessary to be of legal age and not be temporarily suspended from membership or indefinitely banned from membership by Arkipedia in accordance with Article 5.2 of this agreement.

5- Rights and Obligations
5.1. USER’S RIGHTS AND OBLIGATIONS
a) User; While fulfilling the membership procedures, benefiting from the Site’s Services and performing any transaction related to the Site’s Services, it will comply with all the terms in the User Agreement, the rules specified in the relevant parts of the Site and all applicable legislation, He accepts, declares and undertakes that he understands and approves all the stated terms and conditions.

b) The User acknowledges that, in accordance with the mandatory legislation in force or in cases where the rights of other Users and third parties are alleged to have been violated, Arkipedia.net will be authorized to disclose its confidential/private/commercial information to both official authorities and rightful persons, and for this reason, Arkipedia. accepts, declares and undertakes that no compensation can be claimed under any name.

c) Users accept, declare and undertake that the information and content provided by them within the Site are accurate and lawful (Users specifically state that the images they upload, share or transmit to Arkipedia by any means are not subject to copyright or that they have received written permission from the rights owner. confirms.). Arkipedia is not obliged or responsible to investigate the accuracy of the information and contents transmitted to Arkipedia by the Users or uploaded, modified or provided by them through the Site, and to undertake and guarantee that this information and contents are safe, accurate and lawful, and the information in question is not and cannot be held responsible for any damage that may occur due to incorrect or inaccurate content.

d) Users cannot transfer their rights and obligations under the User Agreement, partially or completely, to any third party without the written consent of Arkipedia.

e) Those who benefit from the Services offered by Arkipedia and use the Site may only perform transactions on the Site for lawful purposes. Users bear all legal and criminal liability for every transaction and action they make within the Site. Each User may use the images, texts, visual and audio images, video clips, files, databases, programs, software, source codes, catalogs and other materials contained within the Site in a way that would constitute an infringement of the same or personal rights or assets of Arkipedia and/or another third party. It accepts, declares and undertakes that it will not reproduce, copy, distribute or process the lists, and that it will not compete with Arkipedia directly and/or indirectly, either through these actions or through other means. Arkipedia cannot be held responsible in any way, directly and/or indirectly, for any damages that third parties have suffered or may suffer due to the activities carried out by Users on the site contrary to the provisions of the User Agreement and/or the law. Arkipedia reserves all rights of lawsuit, complaint and recourse against those who act otherwise.

f) Arkipedia is a dynamic website. Due to its infrastructure, it works with many add-ons. In order for the plugins to recognize each other and to set up the functions correctly, the username that users choose when registering to the site cannot be changed. It is not possible to change the database without directly intervening. In order to prevent damage to the site software and to keep the user experience high, usernames are not changed. Since it is not possible to change and user names are clearly visible to everyone, user names are changed to first name, surname, etc. in order to protect the data. It cannot contain identification information or passwords; arkipedia does not accept responsibility if any part of the identification information is written on behalf of the user. Users who become members of Arkipedia accept, declare and undertake that their usernames cannot be changed.

5.2. RIGHTS AND OBLIGATIONS OF ARKİPEDIA
a) Arkipedia reserves the right to change all services and all content offered on the Site at any time without prior notice.

b) The accounts of those who mislead other users by using the same or similar username of one of the people in the site management and who act to cause material/moral harm to the management or other people will be closed.

c) Each user can only have one account, creating more than one account is prohibited. For this reason, the accounts of users who are detected or predicted to have created more than one account will be frozen or deleted. Arkipedia does not have to provide a reason or evidence for freezing or deleting accounts.

d) Arkipedia may offer services in various sections such as support, questions, dictionary, profile areas, groups or forums for the benefit of its users. These services are subject to rules. In case of violations of the rules stated below, the penalties determined by the site management will apply;

-Threatening against real life.
-Style, speaking slang.
-To insult, to humiliate.
-To curse.
-To advertise.
-Selling the purchased membership for commercial purposes.
-Selling the license or product for commercial purposes.
-Transferring the license to someone else.
-To provoke users against the administration, to claim that the site administration takes sides.
-Account hacking.
-Sharing or disclosing others’ personal information without permission.
-Imitating the admin or management, acting like an admin.
-Flood, writing meaningless characters.
-Racism, separatism, politics.

e) Arkipedia may make changes to the user agreement without prior notice. Changes made are valid from the moment they are published on the site. Users frequently accept, declare and undertake that they will read this agreement and rules.

    6.1 Balance Types
    Spending time on Arkipedia, completing various tasks, and making comments and shares earns you virtual points and diamonds.

Users can convert the virtual points and diamond balances they earn into virtual credits and spend on file downloads and various services.

Points, Diamonds and Credit balances are completely virtual and do not have any financial value, users cannot claim rights on virtual balances.

When deemed necessary, Arkipedia management may reset all balances, make adjustments such as decreasing or increasing, and send gift balances to members by offering various campaigns without prior notice.

6.2 Product Publishing and Sales
Users can publish digital products such as 3D models and drawings and sell them with virtual credit in the amount they specify.

6.3 Subscription Types
Arkipedia may offer special, paid or free subscription plans for different types of individuals or groups. It has the right to make changes, add new types and discontinue subscription plans and subscription prices without prior notice.

Arkipedia can offer paid subscription plans free of charge by providing various campaigns to members, and can cancel members’ subscriptions when necessary.

6.4 Return Conditions
All services and products purchased are within the scope of services performed instantly electronically or intangible goods delivered instantly to the consumer and are non-refundable. There is no right of withdrawal for products or services that are performed immediately. All members accept, declare and undertake these terms.

  1. Other Provisions
    8.1. INTELLECTUAL PROPERTY RIGHTS

8.2. CONTRACT CHANGES
Arkipedia may, at its sole discretion and unilaterally, change this User Agreement at any time it deems appropriate, without prior notice. This User Agreement cannot be changed by unilateral statements of the User.

8.3. FORCE MAJEURE
In all cases legally considered ‘force majeure’, Arkipedia is not liable for late or incomplete performance or non-performance of any of its obligations specified in this User Agreement. These and similar situations will not be considered as delay, incomplete performance, non-performance or default for Arkipedia, and no compensation can be claimed from Arkipedia under any name for these situations. The term “force majeure” means events that are beyond the reasonable control of the relevant party and cannot be prevented despite due diligence, including but not limited to natural disasters, riots, war, strikes, communication problems, infrastructure and internet failures, power outages and bad weather conditions. will be interpreted as events that cannot be avoided.

8.4. APPLICABLE LAW AND AUTHORITY
Turkish Law will be applied in the implementation, interpretation and management of legal relations arising within the scope of this User Agreement.
Izmir Courts and Enforcement Offices are authorized to resolve any disputes that arise or may arise from this User Agreement.

8.5. TERMINATION OF THE CONTRACT
This User Agreement will remain in force as long as the User is a member of the Site and will continue to have provisions and consequences between the parties; It will be deemed to have ended if the User’s license expires or his/her membership is temporarily or permanently suspended. Arkipedia may terminate the agreement unilaterally in case the Users violate this User Agreement and/or similar rules regarding the use, membership and Services on the Site, and especially in the cases listed below, and the Users will be liable for the following: Arkipedia will be liable to compensate for all damages suffered by:

1) The User engages in behavior that may harm the operation of the Site by using any method,
2) The User allows someone else to use the membership account created for him or her or shares the product he/she purchased and uses warez,
3) The User is involved in acts that violate and/or are in danger of violating the rights of third parties.

  1. LEGAL LIABILITY
    Our site aims to respect the law, statutes, copyrights and personal rights. Our site serves as a “location provider” as defined in Law No. 5651. According to the relevant law, the Site management has no obligation to control illegal content. For this reason, our site has adopted the ‘warn and remove’ principle.
